The RELIHC’s Messaging Privacy Policy SMS Terms and Conditions Telephone-Call and Telehealth Recording Administrative and Business Telephone Calls

The Resilient Life Integrative Health Center LLC (“The RELIHC,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This policy explains how we collect, use, disclose, retain, and protect information associated with our SMS/text-messaging program and describes the terms that apply when you receive text messages from us.

Relationship to Our HIPAA Notice of Privacy Practices
This policy supplements, but does not replace, The RELIHC’s HIPAA Notice of Privacy Practices. Our Notice of Privacy Practices describes how medical and behavioral-health information may be used and disclosed, explains your privacy rights, and describes our legal responsibilities under the Health Insurance Portability and Accountability Act (“HIPAA”), applicable Arizona law, and, when applicable, 42 CFR Part 2.

If this policy conflicts with our HIPAA Notice of Privacy Practices or applicable law, the HIPAA Notice of Privacy Practices and applicable law will control.

By opting in to receive SMS messages from The RELIHC, you agree to receive conversational messages related to your interactions with our team.

Message frequency: Message frequency may vary. On average, 1-2 messages per month.

Information We Collect
When you enroll in, use, or interact with our SMS messaging services, we may collect:

  • Your name and mobile telephone number;
  • Your email address and other basic contact information;
  • Your consent and communication preferences;
  • The date, time, source, and method through which consent was obtained;
  • The content of messages you send to or receive from us;
  • Appointment, scheduling, billing, payment, insurance, referral, and administrative information;
  • Information you voluntarily provide through text messages, which may include health-related information;
  • Message-delivery information, including delivery status, failed-delivery notices, opt-out requests, and interaction history;
  • Information needed to respond to your questions or requests; and
  • Technical information provided by our messaging platform or telecommunications carrier that is necessary to transmit, manage, secure, and document messages.

Please do not send Social Security numbers, payment-card information, detailed medical information, psychotherapy information, substance-use-disorder information, or other highly sensitive information through standard text messages. We may direct you to Athenahealth’s secure patient portal or another secure method when sensitive information must be exchanged.

How We Collect Information
We may collect messaging information:

  • Directly from you when you complete a form, provide verbal or written consent, schedule an appointment, register for services, contact our office, or exchange messages with us;
  • Through our website, secure patient portal, intake or registration process, or other RELIHC communication channels;
  • From a parent, legal guardian, personal representative, referral source, payer, or other authorized person when permitted by law; and
  • Automatically through our messaging platform when messages are sent, received, delivered, declined, or responded to.

How We Use Messaging Information
We may use messaging information to:

  • Send appointment confirmations, reminders, rescheduling notices, and cancellation information;
  • Respond to questions or requests submitted through text messaging;
  • Provide administrative, billing, payment, insurance, referral, and care-coordination information;
  • Provide information about services you requested;
  • Conduct authorized two-way communications;
  • Communicate office closures, changes in operating hours, or other practice-related notices;
  • Confirm and document consent and communication preferences;
  • Process and document opt-out requests;
  • Maintain the security, reliability, and proper operation of our messaging services;
  • Comply with clinical, legal, regulatory, licensing, contractual, auditing, and record-retention obligations; and
  • Protect the rights, safety, and property of patients, workforce members, The RELIHC, and others.

The RELIHC does not use SMS messaging as a substitute for emergency services, crisis intervention, psychotherapy, psychiatric evaluation, or other clinical treatment.

Specially Protected Health Information
The RELIHC complies with applicable federal and Arizona confidentiality requirements, including HIPAA, Arizona laws governing medical and behavioral-health records, and 42 CFR Part 2 when applicable.

Psychotherapy Notes, Marketing, and Sale of Information
We will obtain your written authorization before using or disclosing protected health information for purposes that require authorization under applicable law, including:

  • Most uses and disclosures of psychotherapy notes;
  • Marketing involving protected health information, except where otherwise permitted by law; and
  • The sale of protected health information.

Your enrollment in the SMS program is not a HIPAA authorization and does not authorize The RELIHC to disclose protected health information for marketing, sale, or another purpose requiring written authorization.

Substance-Use-Disorder Records
To the extent The RELIHC creates, maintains, receives, or transmits substance-use-disorder patient records protected by 42 CFR Part 2:

  • Those records will be used or disclosed only as permitted by applicable law;
  • SMS consent or enrollment does not constitute consent for the disclosure of Part 2 records;
  • When required, a separate written consent must authorize the use or disclosure of Part 2 records;
  • A valid consent may authorize future uses and disclosures for treatment, payment, and healthcare operations as permitted by Part 2;
  • Part 2 records will not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against the patient without the patient’s written consent or a qualifying court order and subpoena or similar legal mandate;
  • Part 2 records will not be used for fundraising communications without the notice and choice required by law; and
  • Breaches involving unsecured Part 2 records will be addressed according to applicable breach-notification requirements.

Consent to Receive Messages
By voluntarily providing your mobile telephone number and opting in, you authorize The RELIHC to send SMS messages consistent with the consent you provided. Messages may include:

  • Appointment confirmations and reminders;
  • Scheduling and rescheduling communications;
  • Administrative and billing notices;
  • Requested information about RELIHC services;
  • General two-way communications; and
  • Practice or service updates.

Consent to receive informational messages is not consent to receive marketing or promotional messages. If The RELIHC offers promotional SMS messages, we will obtain any separate express written consent required by law.

Consent to receive text messages is not a condition of purchasing services or receiving treatment from The RELIHC.

Message Frequency
Message frequency varies based on your appointments, requests, services, communication preferences, and interactions with The RELIHC. You may receive more than one message in connection with an appointment or request.

Message and Data Rates
Message and data rates may apply according to your wireless carrier and service plan. The RELIHC does not charge a separate fee for participating in its SMS program.

Opting Out and Revoking Consent
You may withdraw your consent and stop SMS messages at any time by replying:

STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE
You may also communicate a clear request to stop messages through another reasonable method, including contacting The RELIHC directly at info@TheRELIHC.com.

We will honor a valid opt-out request within a reasonable period, not exceeding 10 business days after receipt. You may receive one non-promotional message confirming your opt-out. After the opt-out is processed, we will not send additional SMS messages requiring your consent unless you provide consent again.

You may reply HELP for assistance.

Opting out of SMS messaging does not prevent The RELIHC from contacting you through another lawful and authorized communication method, such as telephone, email, mail, or the secure patient portal.

Disclosure of Messaging Information
We may disclose messaging information only as reasonably necessary:

  • To SMS platform providers, telecommunications carriers, information-technology vendors, security providers, and other contractors that help operate our messaging services;
  • To healthcare providers, payers, or other persons involved in your care or payment for care when authorized or otherwise permitted by law;
  • To professional advisors, auditors, insurers, accrediting organizations, or consultants who provide services to The RELIHC and are subject to appropriate confidentiality obligations;
  • To comply with applicable laws, regulatory requirements, court orders, subpoenas, or other lawful governmental requests;
  • To investigate fraud, security incidents, misuse, or serious threats to health or safety;
  • To assert or defend legal rights or claims; or
  • In connection with a lawful organizational restructuring, financing, acquisition, or transfer of business assets, subject to applicable privacy and confidentiality requirements.

Vendors that create, receive, maintain, or transmit protected health information on our behalf must enter into a Business Associate Agreement when required and comply with applicable privacy and security requirements.

No Sale or Marketing Disclosure of Mobile Information
The RELIHC does not sell mobile information.

We do not share mobile telephone numbers, SMS consent, or opt-in information with third parties or affiliated organizations for their independent marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be sold, rented, or transferred for third-party marketing.

This restriction does not prevent The RELIHC from providing information to contracted messaging vendors and telecommunications carriers solely as necessary to operate the SMS program or from making a disclosure required by law.

SMS Security and Confidential Communications
Standard SMS messaging is not the same as a secure patient portal and may not always be encrypted. Messages may be viewed by anyone with access to your telephone, wireless account, shared device, lock-screen notifications, or message backups.

The RELIHC uses reasonable safeguards and limits the health information included in SMS messages when appropriate. We may verify your identity or redirect a communication to the secure patient portal before discussing sensitive information.

You may request that we contact you through a particular method, telephone number, or address. We will accommodate reasonable requests for confidential communications as required by law.

Choosing SMS communication does not waive your rights under HIPAA, 42 CFR Part 2, Arizona confidentiality laws, or The RELIHC’s Notice of Privacy Practices.

Protection of Information
We use reasonable administrative, technical, and physical safeguards designed to protect messaging information from unauthorized access, alteration, loss, use, or disclosure and to support the confidentiality, integrity, and availability of electronic protected health information.

No electronic communication or storage system can be guaranteed to be completely secure. If a breach occurs that may have compromised the privacy or security of protected information, we will provide notification as required by applicable law.

Retention of Information
We retain messaging information only as long as reasonably necessary to:

  • Provide and document services;
  • Maintain appropriate clinical and business records;
  • Document consent and opt-out requests;
  • Resolve disputes;
  • Protect security; and
  • Satisfy legal, regulatory, licensing, contractual, and record-retention requirements.

Messages that are clinically or administratively relevant may become part of the patient’s designated medical record and will be retained according to applicable record-retention requirements.

Your Privacy Rights
Subject to applicable law, you may have the right to:

  • Request access to an electronic or paper copy of your medical record;
  • Request correction or amendment of information you believe is inaccurate or incomplete;
  • Request confidential communications;
  • Ask us to restrict certain uses or disclosures;
  • Request an accounting of certain disclosures;
  • Obtain a paper or electronic copy of our HIPAA Notice of Privacy Practices;
  • Designate an authorized personal representative; and
  • File a privacy complaint without retaliation.

Requests involving protected health information will be handled according to The RELIHC’s HIPAA Notice of Privacy Practices and applicable law.

Delivery Limitations
SMS delivery depends on wireless carriers, networks, devices, and third-party messaging providers. Messages may be delayed, blocked, misdirected, or undelivered for reasons outside The RELIHC’s control.

The RELIHC cannot guarantee uninterrupted or error-free delivery. Nothing in this section limits any privacy, security, or consumer right that cannot lawfully be waived.

Emergencies and Crisis Services
Do not use SMS messaging to report an emergency or urgent safety concern. Messages may not be reviewed immediately.

  • For a medical or life-threatening emergency, call 911.
  • For suicide, mental-health, or substance-use crisis support, call or text 988.

Changes to This Policy
We may update this policy periodically. If we make a material change, we will post the revised policy on our website and update the effective date. When required by law, we will provide additional notice before the change becomes effective.

The current version will be available upon request and through The RELIHC’s website.

Telephone-Call and Telehealth Recording
Administrative and Business Telephone Calls
Telephone calls to or from The RELIHC may be monitored or recorded for quality assurance, workforce training, documentation, security, regulatory compliance, and dispute-resolution purposes. Callers will be notified before recording begins or at the beginning of the call. When required by applicable law, The RELIHC will obtain consent before recording.

If you do not want an administrative call recorded, please inform the RELIHC representative before continuing. When reasonably available, we will stop the recording or offer another communication method, such as secure portal messaging, email, mail, or an unrecorded telephone call.

Call recordings may contain personal information or protected health information. Recordings will be accessed only by authorized individuals, protected through reasonable administrative, physical, and technical safeguards, and retained only as long as necessary to satisfy quality-assurance, clinical, operational, legal, and regulatory requirements. A recording that becomes part of a patient’s clinical or designated record will be managed according to HIPAA, applicable Arizona law, 42 CFR Part 2 when applicable, and The RELIHC’s Notice of Privacy Practices.

Telehealth Appointments
The RELIHC will obtain and document the patient’s or authorized healthcare decision-maker’s informed consent before providing telehealth services, as required by applicable law.

Telehealth appointments are not routinely audio- or video-recorded. If The RELIHC determines that recording a particular appointment is clinically, legally, educationally, or operationally necessary, the patient or authorized healthcare decision-maker will receive advance notice describing:

  • The purpose of the recording;
  • Whether audio, video, screen activity, or another form of information will be captured;
  • Who may access the recording;
  • How the recording will be used;
  • Where and how it will be stored;
  • How long it will be retained;
  • Whether it will become part of the medical record;
  • Whether it may be disclosed and under what authority; and
  • The consequences, if any, of declining the recording.

A telehealth appointment will be recorded only after any consent required by applicable law has been obtained and documented. When the patient is a minor or has a legally authorized representative, consent will be obtained from the appropriate parent, guardian, or healthcare decision-maker, and the patient’s assent will be obtained when developmentally and clinically appropriate.

Consent to participate in telehealth does not automatically constitute consent to record the appointment. Consent to recording must be obtained separately. A patient may withdraw consent to an ongoing recording at any time, although withdrawal will not affect portions already lawfully recorded. Any effect that declining or withdrawing consent may have on a particular service will be explained before consent is requested.

To protect the privacy of everyone participating, patients, caregivers, visitors, and other participants may not independently photograph, audio-record, video-record, livestream, or otherwise reproduce a telehealth appointment without advance authorization from The RELIHC and the consent of all participants required by applicable law.

Telehealth recordings containing protected health information will be stored and transmitted using approved safeguards. The RELIHC will not use a recording for marketing, public presentation, external education, research, or another purpose requiring authorization without obtaining the appropriate separate written authorization.

Privacy and Security Limitations
Participants should attend telehealth appointments from a private location, use a secure internet connection when available, wear headphones when privacy is limited, and identify every person who can see or hear the appointment. The RELIHC cannot control or guarantee the privacy of the patient’s location, device, internet connection, or other persons present outside The RELIHC’s environment.
